Please note all terms and conditions are subject to change without notice.
Full day coverage available at extra cost for Jura, Islay and Skye albums.
All Islay and Skye album prices include monochrome conversion, toning, and manipulation etc. up to a maximium of 50% of the album pages. Thereafter a charge will be applied per print. All Contemporary and Storybook albums are all inclusive and only in exceptional circumstances will a surcharge be applied, clients would be notified in advance.
**Photography only service pictures on CD only.
All images supplied as jpgs sized to 300dpi @ 2400px x 1800px suitable for printing. Images only are provided and the client is responsible for printing and album production. No preview album/CD is available with this package. All work is limited to the production of the images on the CD only. All further work will be charged for at our standard rates. No other liabilities will be accepted, all images remain the copyright of K & M Photography and are licensed for reproduction by the client for personal use only. The images must not be used for any other purposes unless written permission is obtained from K & M Photography.
Special Offers
Our special Offers are not subject to any further discounts or promotions. All offers are subject to availability and are time limited.
Prices Mid-Week and Seasonal Discounts.
We no longer offer mid-week or seasonal discounts. Holders of any discount cards are no longer able to claim discount on weddings for year 2010 onwards. All discount cards are valid until the end of December 2009 only, even though they might still be given out.
Time
If the time† for photography is 3 hours or more then the client is liable to provide a meal or/of sandwiches for the photographer and his assistants. Our time begins when we arrive at the venue.
All sales are subject to these terms and conditions. K & M Photography reserve the right to change these terms without notice.
Reprints, Enlargements, Albums, Gift Vouchers and Wedding Packages.
All our Wedding Packages are flexible and subject to change without notice. Packages can only be supplied subject to availability from our suppliers. K & M Photography cannot be held liable for any changes relating to supply being unavailable.
All Gift Vouchers ( Portrait, Wedding and Pre/Post Wedding) can only be used for the purpose intended they are non refundable and have no monetary value in event of exchange, they can only be used expressedly for the purpose stated. K & M Photography cannot be held liable for any changes in circumstances of third parties eg. in the event of a wedding cancellation. All Gift Vouchers ( Portrait, Wedding and Pre/Post Wedding) must be used within 2 years of the date of purchase.
Payment
Booking Fees are payable on all our Wedding Packages they are shown deducted from the total to pay in our On-Line Shop. Final payment for any event is payable in advance, weddings must be paid in full no less than 30 days prior to the event. All special offers available from our website must first be confirmed by email. Failure to do so will result in cancellation of the offer and will be subject to a 10% handling charge for the client. Payment of any offers must be made within 2 days of reply and may be made either by cheque or via PayPal on our website. Any errors/mistakes made by the client via PayPal will be subject to a 10% handling charge. It is the responsibility of the client to ensure that they have made the right choice/decision before any payment occurs. We reserve the right to withdraw any and all special offers at any time without notice.
Booking Deposit
A deposit of £250.00 is required at the time of booking, together with a signed contract. Dates are reserved only when this deposit is paid. Please make cheques payable to K & M Photography. Payment may be made online by credit card via Paypal incurring a charge of 2.0%. An unconditional refund policy exists for a period of 14 days from receipt of this contract and payment. Booking payments are non-refundable.
As all our products are essentially 'made to order', payment is required before work is commenced. Payment is accepted by cheque or via PayPal on our website.
Fees
Includes all photography, two 8” x 6” prints from your pre-wedding shoot (if applicable), and wedding album containing your choice of photographs. Numbers of photographs may vary depending on wedding package chosen. Further prints in your album are priced at £40.00 each, futher charges may be applied if digital post production work is required at our standard rates.
Creative Licence
Kenny and May Wood shall be granted creative and artistic licence in relation to the choice of locations and poses used. Our judgement on photographic style and the number of photographs taken, shall be deemed correct. Due to changes of the weather and the availability and willingness of subjects K & M Photography will do their best to honour
requested photographs but do not undertake to guarantee any specific picture nor incorporate any specific background, location or group arrangement.
Our Cancellation
If K & M Photography has to cancel this contract for reasons beyond their control, (death, injury, sickness etc.), their liability shall be limited to a full refund of all monies paid.
Your Cancellation
After a period of 14 days from the date of signing the contract, as compensation for loss of income for K & M Photography the following charges apply as a percentage of the total fee due.
(Number of days before the wedding) 60 days or less - 100% 61-90 days - 75%. 91-120 days - 50%.
Should the cancelled wedding turn out to be a postponement, then, subject to availability, all money paid may be applied to the new wedding. In this case, the total fees chargeable shall be the fee which applies at that time.
In the event of K & M Photography taking another wedding booking for your cancelled or postponed date a full unconditional refund of your deposit and monies paid shall be made.
Viewing
A mutually convenient appointment for viewing of photographs will be made upon return from honeymoon. The images will be projected, and also be available on-line on. You will be required to make your album selection at that time within 12 weeks of returning from honeymoon thereafter a surcharge of £200 will apply. Also delivery of your album may be delayed for an unspecified time. This time depends on our ability to complete your order due to further work commitments, however we will make every effort to complete your order as soon as possible.
Exclusivity
Kenny and May Wood shall be the sole professional (still) photographers at the venues specified. We do however positively encourage family, friends, and other guests to take photographs throughout the day as long as they do not interfere and cause unneccessary delay.
Force Majeure
In the unlikely event of total photographic failure, injury or sickness beyond K & M Photographys’ control, their liability shall be limited to a full refund of all monies paid. Your statutory rights are not affected. K & M Photography has full Public Liability, and Professional Indemnity Insurance.
Traveling costs
Traveling cost are applicable when the distance to the event is 30 miles or more from our studio. Overnight accommodation costs must also be met by the client should the event take place at a distance that makes traveling to and from the event unreasonable within a normal working day. Please contact us for further clarification.
Postage
Postage will be charged at the rate applicable on the date of posting, all orders are sent by either recorded delivery or special delivery. We cannot be held responsible for missing or delayed goods due to circumstances out with our control. We always encourage clients to collect in person.
Conformation of acceptance of satisfaction
All items offered for sale will only be available if the item(s) is/are signed off either in writing or by email prior to printing or final production, we do not accept returns later (see below). Clients will be emailed a pdf file for approval, we must receive conformation that is acceptable without compromise, only then will we proceed with the final order. We are unable to reprint or replace any items should it later be decided that you are dissatisfied in any way other than that mentioned below.
Refunds / Returns
The bespoke nature of each product means that we can only offer refunds or replacements where the materials are damaged or there is some error on our part or on our suppliers. In this case contact us immediately to allow us to arrange a refund or replacement. We are unable to provide a refund or replacement for any other reason other that that stated above and all sales are deemed final. Return of the item is the responsibility of the client and any items returned must be adequately packed and insured to ensure safe arrival. Returned items must be found to be in the condition supplied with any and all original packing. Please note we now meticulously inspect all goods before you receive them for faults.
All book sales are final, all images are subject to cropping and manipulation to fit the format of the book. All cropping, colour balance, exposure, manipulation and layout of all images are at our discretion. Only agreed work will be changed prior to printing, we are unable to reprint or change images after final approval is obtained. Any changes thereafter will be at the clients expense.
Size and Colour Matching
All sizes are nominal: there may be minor variations from those quoted. K & M Photography will endeavor to produce the closest colour match within the limitations of materials and processes. However, we cannot be held responsible for lighting circumstances out with our control.
Copyright and Reproduction
The copyright of all photographs created by K & M Photography shall be and shall remain the property of K & M Photography in accordance with the Copyright, Designs and Patents Act 1988. Clients have no right to reproduce or authorise reproduction of any of the photographs by any means whatsoever including photocopying, scanning into computer, copying onto film, videotape or any other electronic media. Any infringement of this is unlawful and may be deemed a criminal offense unless the client has permission to do so from K & M Photography in writing or the contract for the images provided allows reproduction. See conditions within the original contract.
Complaints Procedure
Please address any complaints to K & M Photography either by e-mail or telephone 01290 552195 09.00hrs - 17.00hrs Mon - Fri. 24hrs Standard UK call rates apply. We will endeavour to respond to any complaint within 48 hours.
Privacy
K & M Photography and K & M Photography's suppliers will use customers details for payment, record keeping and shipping purposes only, unless otherwise agreed. Private details are never used for marketing purposes nor passed onto any other third party for that purpose.
